Personal Injury Involving a Medicaid Recipient

The attorney should ask his or her client if he or she has ever received Medicaid benefits for the payment of any medical treatments. The attorney could also request the medical billing records from the provider to determine whether or not Wisconsin Medicaid reimbursed the provider for the service(s). If Wisconsin Medicaid did reimburse the provider for the service(s) or if there is a question about whether or not the client has received Medicaid benefits, the attorney can contact the Casualty Recovery Program. Information regarding any potential claim will be provided. 

If Wisconsin Medicaid Is Involved:

Notify the Casualty Recovery Program if the client decides to pursue recovery from a third party responsible for his or her injuries including worker's compensation. Fax the request to (608) 261-7793 or mail it to:

Supply the client’s name, his or her Social Security number, the date of the accident, the name of the third party involved and/or the name of his or her insurance carrier, and the type of injury suffered. Include a signed authorization for release of information.

Further Requirements

Sections 49.89 and 102.27(2)(b), Wis. Stats., set forth the statutory requirements in third-party claims. Contact the Casualty Recovery Program for an updated lien amount before payment is mailed.
